Susspect for BOTNET!
I use a port scanner and ASN port scanner.
I recive a ticket about botnet activity But i am not flooding/DDoS/BoTNet. i just do port scanning.
I ToS is nothing about portscaning and i think is not illegal.
Can someone help me what to do cuz they keep saying is a violation, tried explain but my english is bad.
What i need to do?

I suggest you stop doing what you're doing. Just because something is legal, does not make it right…or acceptable. Port scanning (IMHO) violates Article 4 of the the Linode Acceptable Use Policy (to which you agreed when you signed up).

i am not doing any vulnerability scan. port scan is not a vulnerability scan. port open check is not vulnerability or penetration test
I would disagree. If you are port scanning a host you do not know anything about then you are trying to discover which services are open on it.
This information should be available to you by asking the service owner etc you shouldn’t need to discover it.
The obvious, even if incorrect, conclusion that anyone would jump to is you are searching for open services.
If you scanned a couple of hosts perhaps ok, but if you’re scanning lots then I can’t think of any good reason to do that unless you are a security researcher.
As the terms said you should have, and still should, contact support and explain openly what you are doing and why. If you can’t do that then they would be right to treat you suspiciously - I would.

I agree with @hey… Port scanning other systems without the other owners' knowledge violates the acceptable use policy. However, if you are port scanning your own system looking for open doors, that's perfectly ok.
Maybe you just accidentally misconfigured your port scanner…
